The Numo Kofi Anum Family of Tesa has issued a strong statement in response to claims made by Regimanuel Gray Limited regarding a land dispute over 918.24 acres of land in Ghana. The family reaffirms its ownership rights, citing a Supreme Court judgment that upheld their allodial ownership of the land.
According to the family, the Supreme Court of Ghana has affirmed that the Tesa Family is the lawful and allodial owner of over 918.24 acres of land. This judgment underscores the family’s legitimate claim to the land in question.
Regimanuel Gray Limited occupies 123.2088 acres within the Tesa Family’s land. The Tesa Family notes that the judgment has already been executed, with the family taking possession of vacant portions of the land through Court bailiffs.
The Court found that the land titles relied upon by Regimanuel Gray Limited were wrongfully issued by the Nungua Stool. The Nungua Stool had already lost ownership of the land, rendering the titles invalid.
The Tesa Family clarifies that the 12-month stay of execution granted by the Court was not a relief from liability. Instead, it was an opportunity for Regimanuel to negotiate in good faith with the Tesa Family regarding the land. Regrettably, Regimanuel failed or refused to engage in any meaningful negotiations during this period.
The Family’s parent judgment in the Nii Mate Tesa case — covering the entire 918.24 acres — has already been executed and subsists in full force. An appeal filed by Regimanuel does not contest the family’s allodial ownership; hence, it does not impeach the Supreme Court judgment.
The Family’s Position
The Tesa Family reaffirms that:
1.They are the undisputed allodial owners of the 918.24 acres, including the area unlawfully occupied by Regimanuel.
2.The Supreme Court judgment in their favour remains binding and has not been overturned or stayed.
3.They are no longer interested in any settlement negotiations with Regimanuel.
4.They will pursue all lawful means to enjoy the full fruits of their judgment.
